These Terms and Conditions (“Terms”) govern your access to and use of www.mjmobilerepair.com (the “Website”) and the online features provided by M&J Mobile Diagnostics and Repair (“M&J,” “we,” “our,” or “us”).
Please read these Terms carefully. By accessing the Website, submitting a service request, or otherwise using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Website.
1. Website Purpose
The Website provides general information about M&J, our mobile diagnostic and automotive repair services, service availability, and ways to contact us or request an appointment.
Website content is provided for general informational purposes. It does not constitute a professional diagnosis, guaranteed estimate, repair authorization, warranty, or promise that a particular service, part, price, technician, date, or time will be available.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to request or authorize services.
By requesting service for a vehicle, you represent that you are the vehicle’s owner or have the owner’s permission and legal authority to authorize inspections, diagnostics, repairs, road testing, and related services.
3. Appointment Requests
Submitting a form, email, text message, social media message, or telephone request does not create a confirmed appointment.
An appointment is confirmed only after M&J accepts the requested date, time, service location, vehicle information, and anticipated scope of work. Appointment times and arrival windows are estimates and may be affected by traffic, weather, parts availability, emergencies, earlier service calls, or conditions outside our reasonable control.
We will make reasonable efforts to notify customers of significant scheduling changes.
4. Vehicle and Service Information
You agree to provide accurate and complete information, including:

Your name and contact information.

The vehicle’s year, make, model, mileage, and identification details.

The vehicle’s location.
-
A description of known symptoms or damage.
-
Relevant warning lights, previous diagnoses, service history, modifications, or recent repairs.

Known safety issues or hazardous conditions.
-
Any information reasonably requested to evaluate or complete the service.
M&J is not responsible for delays, additional costs, or unsuccessful service resulting from inaccurate, incomplete, or withheld information.
5. Diagnostics and Online Advice
Automotive symptoms may have multiple causes. Information exchanged through the Website, telephone calls, emails, photographs, videos, text messages, or social media is preliminary and cannot replace a physical inspection or appropriate diagnostic testing.
Any online or telephone opinion is based solely on the information provided and is not a final diagnosis or guarantee.
Diagnostic fees compensate M&J for technician time, travel, testing, equipment use, research, and professional evaluation. Unless expressly stated in writing, a diagnostic fee is payable regardless of whether:

A repair is authorized.

The vehicle can be repaired at its current location.

A specific fault is immediately identified.

The customer chooses to complete the recommended repair.

Additional testing is required.
6. Estimates and Repair Authorization
Any price displayed or discussed before inspecting the vehicle is an initial estimate only. Final pricing may vary based on the vehicle’s condition, diagnostic results, labor requirements, parts availability, taxes, travel distance, access conditions, and additional problems discovered during service.
M&J will obtain the customer’s authorization before performing work beyond the authorized scope when required. Authorization may be given through a signed document, electronic approval, email, text message, recorded telephone authorization where lawful, or another accepted method.
If additional work is recommended, the customer may approve or decline it. Declining recommended work may leave the vehicle unsafe, unreliable, incomplete, or unable to operate.
7. Service Location and Customer Responsibilities
Mobile service must be performed in a location that M&J determines is legal, accessible, stable, and reasonably safe.
The customer is responsible for:

Providing an accurate service address.

Ensuring M&J has permission to enter and work on the property.

Providing adequate space around the vehicle.
-
Placing the vehicle on a stable and reasonably level surface.
-
Removing personal belongings that may interfere with service.
-
Keeping children, pets, customers, and bystanders away from the work area.
-
Disclosing hazardous materials, dangerous conditions, or security restrictions.
-
Providing keys, wheel-lock keys, alarm codes, or access information when necessary.
-
Ensuring that parking rules, property rules, or local restrictions permit the work.
M&J may refuse, suspend, or relocate service if conditions are unsafe or unsuitable. Examples include active roadways, prohibited parking areas, unstable ground, severe weather, inadequate lighting, fire hazards, aggressive animals, threatening behavior, or insufficient working space.
A service-call, travel, cancellation, or diagnostic charge may still apply if work cannot be completed because the customer provided an unsafe, inaccessible, unauthorized, or unsuitable location.
8. Vehicle Access and Testing
By authorizing service, you authorize M&J to access the vehicle and operate its systems as reasonably necessary for inspection, testing, diagnostics, programming, repair, and quality control.
When reasonably necessary and legally permitted, you also authorize M&J to start, move, or road-test the vehicle. Road testing may be limited or declined if the vehicle appears unsafe, is unregistered, is uninsured, lacks valid plates, or cannot legally be operated.
Diagnostic tools may access information stored in vehicle control modules, including fault codes, operating data, mileage, and maintenance information.
9. Parts and Materials
Parts may be new, remanufactured, rebuilt, aftermarket, or used, depending on availability and the customer’s approval.
Availability, delivery dates, manufacturer warranties, and prices are controlled in part by third-party suppliers and may change without notice. M&J is not responsible for supplier delays or discontinued parts beyond our reasonable control.
Removed parts may be discarded, recycled, returned to a supplier as a core, or handled as required by law unless the customer requests their return before service begins. Parts subject to a core charge may not be available for return to the customer unless the applicable core charge is paid.
10. Customer-Supplied Parts
M&J may accept or decline customer-supplied parts at our discretion.
Unless otherwise stated in writing:

M&J does not warrant customer-supplied parts.

The customer is responsible for confirming that the parts are correct and suitable.

Labor, travel, and diagnostic charges remain payable if a supplied part is incorrect, defective, incomplete, or incompatible.
-
Additional labor caused by a defective or incorrect part may result in additional charges.
-
Any labor warranty may be limited or excluded when customer-supplied parts are installed.
11. Preexisting Conditions and Hidden Damage
Vehicles may contain worn, corroded, seized, damaged, modified, previously repaired, or improperly installed components that are not visible before work begins.
M&J is not responsible for preexisting damage or for the failure of unrelated components. If ordinary repair procedures reveal or cause the failure of a severely deteriorated, corroded, brittle, or previously damaged component, additional parts and labor may be required.
We will make reasonable efforts to inform the customer when significant hidden conditions are discovered.
12. Completion of Repairs
Completion dates and times are estimates and are not guaranteed. Delays may result from:

Parts availability or delivery problems.

Unexpected diagnostic findings.

Severe corrosion or seized components.
-
Weather or unsafe working conditions.
-
Manufacturer procedures or programming requirements.
-
Third-party services.
-
Events outside M&J’s reasonable control.
M&J is not responsible for loss of use, missed work, rental-car expenses, towing expenses, storage expenses, lost income, or other costs caused by a delay unless M&J expressly accepts that responsibility in writing.
13. Payments
Payment is due according to the estimate, repair authorization, invoice, or other written agreement provided for the service.
M&J may require:

A service-call or diagnostic fee.

A deposit before ordering parts.
-
Advance payment for special-order parts.
-
Progress payments for extended work.

Full payment upon completion.
Special-order parts, deposits, and completed labor may be nonrefundable to the extent permitted by law. Returned payments, disputed charges, collection expenses, storage expenses, or other costs may be charged where legally permitted.
14. Cancellations and Missed Appointments
Customers should provide as much notice as possible when canceling or rescheduling an appointment.
A cancellation, missed-appointment, travel, or service-call fee may apply if:

An appointment is canceled without sufficient notice.

The customer or vehicle is unavailable at the confirmed time.

M&J cannot access the vehicle.

The address or vehicle information is materially incorrect.

The customer does not have authority to approve the work.
-
The service location is unsafe or does not permit automotive work.
-
Parts were specially ordered for the appointment.
Any applicable fee should be disclosed during scheduling or in the service estimate.
15. Warranties
Any warranty on parts or labor will be limited to the warranty expressly stated on the applicable estimate, work order, invoice, or separate written warranty.
Unless prohibited by law, a warranty may not cover:

Customer-supplied parts.

Normal wear and maintenance items.
-
Misuse, abuse, accidents, racing, overloading, or neglect.

Continued operation after a warning light, leak, overheating condition, unusual noise, or known safety problem.

Damage caused by another person or repair facility.

Unauthorized modifications or repairs.
-
Failures unrelated to M&J’s work.
-
Commercial use beyond the warranty’s stated terms.
-
Consequential expenses such as towing, rentals, lodging, lost income, or loss of use.
Warranty service may require inspection by M&J before another provider performs repairs. Unauthorized third-party work may affect warranty coverage.
Nothing in these Terms limits a warranty or consumer right that cannot legally be limited.
16. Vehicle Safety
A diagnostic evaluation or completed repair does not guarantee that every component of a vehicle has been inspected or that the vehicle is free from unrelated defects.
Unless a complete inspection is specifically requested and authorized, M&J’s work is limited to the reported concern and authorized services.
The customer is responsible for operating and maintaining the vehicle safely. If M&J advises that a vehicle is unsafe to drive, the customer should not operate it until the recommended repairs are completed.
17. Emergency and Roadside Situations
The Website is not an emergency service and may not be continuously monitored.
If a vehicle is stopped in a dangerous location, involved in a collision, leaking fuel, producing smoke or fire, severely overheating, or creating an immediate safety hazard, move to a safe location if possible and contact emergency services or an appropriate roadside provider.
M&J does not guarantee immediate roadside response or availability.
18. Website Accounts and Security
If the Website offers customer accounts, you are responsible for protecting your login credentials and for activity conducted through your account.
You must promptly notify M&J if you believe an account or password has been used without authorization. We may suspend or terminate access when necessary to protect the Website, our customers, or our business.
19. Acceptable Website Use
You may not use the Website to:

Violate any applicable law or regulation.

Submit false, fraudulent, or misleading information.

Impersonate another person or business.

Attempt to access restricted systems or data.

Introduce malware or harmful code.

The Website and its original content—including text, logos, graphics, photographs, videos, designs, service descriptions, and other materials—are owned by or licensed to M&J and may be protected by copyright, trademark, and other laws.
You may view and print Website content for personal, noncommercial use. You may not reproduce, modify, distribute, sell, publish, or commercially exploit Website content without prior written permission.
21. Reviews and User-Submitted Content
If you submit a review, testimonial, photograph, video, suggestion, or other content, you represent that:

You own it or have permission to submit it.

It does not violate another person’s rights.

It does not contain confidential, unlawful, threatening, or defamatory material.
You retain ownership of your content. If you separately authorize M&J to use it, you grant us a nonexclusive, royalty-free license to reproduce, display, and share it for the approved purpose.
22. Third-Party Websites and Services
The Website may contain links to payment processors, mapping services, social media platforms, parts providers, scheduling tools, or other third-party services.
M&J does not control and is not responsible for third-party content, availability, security, products, policies, or practices. Accessing a third-party service is at your own discretion and may be subject to separate terms.
23. Website Disclaimer
To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis.
M&J does not guarantee that:

Website information will always be complete or current.

A particular service, price, part, technician, date, or result will be available.

Online content will diagnose or resolve a specific vehicle problem.
Nothing on the Website replaces an in-person inspection, written estimate, repair authorization, or applicable warranty.
24. Limitation of Liability
To the fullest extent permitted by law, M&J will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from Website use, service delays, loss of vehicle use, lost income, lost data, third-party conduct, or reliance on general Website information.
Nothing in these Terms excludes liability that cannot legally be excluded or limits rights provided by applicable consumer-protection law.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold M&J and its owners, employees, contractors, and representatives harmless from third-party claims, damages, costs, or expenses arising from:

This section does not require you to indemnify M&J for conduct for which indemnification cannot legally be required.

27. Governing Law
These Terms are governed by the laws applicable in the state where M&J Mobile Diagnostics and Repair maintains its principal place of business, without regard to conflict-of-law principles.
Any legal proceeding relating to these Terms or the Website must be brought in a court with proper jurisdiction and venue, unless applicable law requires otherwise.
28. Changes to These Terms
M&J may revise these Terms periodically. Updated Terms will be posted on the Website with a revised “Last Updated” date.
Changes apply prospectively from the date they are posted. Your continued use of the Website after an update constitutes acceptance of the revised Terms.
29. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed as necessary. The remaining provisions will remain in effect.
30. No Waiver
M&J’s failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
31. Entire Agreement
These Terms, the Privacy Policy, and any applicable estimate, repair authorization, invoice, or written warranty constitute the agreement governing the relevant Website use or service.
If these Website Terms conflict with a signed service document, the signed service document will control for that specific service.
